my girlfriend got indicted for calling in vicodins and going to pick them up. its a 3rd degree charge but she has alot of counts against her. what kind of jail time or probation is she looking at. thanks for any help

depends on the mood they are in but being a controlled sustance I would say first offender 2-5 years sentence maybe serve a year

That's what I was thinking. It would be multiple charges if she kept doing it again and again. Example, somebody steals a checkbook with the standard 25 or so blank checks. Each time a check is written it's a new offense.

What do you mean she has alot of counts against her? Does that mean she has several charges for this pending against her or she has several past convictions? Without past convictions I would imagine no jail time and a plea to a misdemeanor with probation at most. Is she charged with some form of distribution or only with attemting to obtain RX drugs without an RX? Also, understand that you have the whole addiction angle and she'll do some sort of treatment program. But list every charge and list her prior convictions of any. It would not hurt to get an RX for Vicoden in the interim.

i dont have her paperwork on me but its 1 count of trying to obtain a controlled substance and possession of 1 tramadol. shes never been on probation but she had the same charge 5 yrs ago but they kept it municipal and just pd a fine. what happen is she called in vicodins using a drs dea # she stole then tried to pick it up when they caught her.

If she looks anything like this, she may be in trouble. Don't think the Judge will show much lieniency

1st offense = probation, lesser counts of the secondary charges will most likely be dropped if and only if it's a first offense and she has no other prior probation charges that would come to life if she got in trouble again (which she did) If it's her second offense she could do some time most likely minimal but it would depend on the prior's. 3rd offense = see ya, start looking for a new woman but keep her on the side, conjical sex is FANTASTIC, if she doesn't turn lesbo on you inside!

Bet the Lakers tonight and load up on the so you can get her a good lawyer, she'll need it!

on a real note though if she really stole the docs number she is going to do some time. Especially since this was her second offense. Depending on the judge but if she gets a prick she could be looking at a lengthy sentance.
